New York Legal Services for Wills, Probate, and Trusts
Wills
The most widely known and accepted form of Estate Planning is the “Will." Having a Will ensures that the assets you have worked so hard to accumulate during your lifetime are protected and distributed to those you love and prevents the need for an estate administration (court process for those individuals who do not have a Will or Trust). Of equal importance, you also set forth the guardian of any minor children who may survive you. If you already have a Will, you may want to review your Will and other estate planning documents to determine whether any changes need to be made. Typically, these documents need to be reviewed after any life changing event such as divorce, death or a birth.
For Estate Planning
Having a Will also helps reduce the stress and conflict among family members! It enables you to make the choices you want for your individual situation, rather than having a court determine the distribution of your assets.

Probate
In its most basic terms, Probate is the court-supervised transfer of title of assets. The goal is to take title out of a deceased person’s name and to put it into a living person’s name. Who the recipient may be of a deceased person’s assets depends upon whether or not that deceased person left instructions in a Will or a Trust identifying the recipient or, if no Will or Trust is found, which statutes apply identifying the recipient by default. Though this explanation of Probate may seem simple, the process usually is not.
In a typical Probate proceeding there are a number of different persons interested in the Probate estate and who must be noticed of the proceeding. The most common are creditors, family members, beneficiaries, the surviving spouse, attorneys, and the personal representative for the estate. Each person has a different interest in the Probate estate that is protected by law. Because of those protected interests, the steps undertaken to complete a Probate can be lengthy, time-consuming, and costly.
Therefore, it is essential that you have an experienced team of attorneys to help you navigate through this process. With the support and guidance of professionals with expertise in probate you rest assured that our team is working for you.
