Getting a Divorce in New York

New York divorces law no longer require a couple to demonstrate legal grounds for getting a divorce, such as abandonment or adultery.  A "no-fault divorce" is handled very differently than "fault divorces." Getting a divorce is no longer about determining who is at fault. All a couple has to demonstrate is that there is an irretrievable breakdown of the marriage for at least six months.

As a result, divorces are often completed in a much more timely fashion barring any contentious litigation. For example, a divorce agreement could potentially be completed within six months if both parties are able to reach an amicable settlement on major issues such as child custody, child support, and property division.


Getting an uncontested divorce means all matters have been decided, and the resolution of such is memorialized into a detailed written agreement called a stipulation of settlement. An uncontested divorce is often the easiest and most cost effective way to dissolve a marriage. Additionally, when the parties are able to remain amicable and avoid litigation, it can have lasting benefits on their relationship with one another, and their children, as it is less traumatic.

The following is a list and explanation of matters that must be resolved when getting an uncontested divorce. If these issues are not resolved, you'll be dealing with a contested divorce.

Child Custody & Visitation
The question that must first be answered when determining child custody and visitation is, "is this in the best interest of the child?" Can the other parent be trusted with child custody? Will they properly feed and clothe the child? Are they capable and willing to take care of any medical issues that arise with the child? These questions and more will help the two parties and their attorneys determine whom should have custody of the child, and what visitation rights, if any, are due the other parent.
