Pre-Nuptial Agreements
In order to avoid difficulties or confusion later on, a prenuptial agreement can clarify the character of certain assets as separate property, gifts, or proceeds of an expected inheritance, all in order to document previous understandings of the parties and to keep assets from being regarded as marital property. The agreement might also define or waive spousal support rights in the event of divorce.
A prenuptial agreement can be highly suitable for people in the following circumstances:
- Marrying for the first time later in life
- Entering into a second or third marriage
- One prospective spouse or the other has grown children
- Substantial commingling of assets or undocumented debt arrangements prior to marriage
- Disparity of income or accumulated wealth between the parties
